SAFFORD — The woman who admitted to participating in sex acts with Paul Ray Simon Garcia against his juvenile daughter was sentenced May 2 to 14 years in prison.
Kristina Lynn Schroeder, 25, accepted a plea agreement that amended two of her charges to attempted sexual conduct with a minor — Class-3 felonies — while keeping a charge of sexual exploitation of a minor — a Class-2 felony — and dropping a charge of sexual abuse.
Schroeder pleaded guilty to the charges relating to Garcia’s juvenile daughter under the age of 15 and no contest to the charge of her participating in the molestation of her own infant daughter.
On May 2, Schroeder was sentenced in Graham County Superior Court to the stipulated plea of 14 years flat time for the exploitation charge, followed by lifetime supervised sex offender probation, upon her release from prison on her attempted sexual conduct with a minor charges.
An arrest warrant was issued for Schroeder the day after she gave birth two months prematurely to a 4-pound and 1 ounce baby boy Oct. 13, 2015. All three of her children have been taken from her and placed into the custody of the Department of Children Services.
Schroeder’s charges stem from crimes she committed with Garcia when she lived with him at a house at 110 S. 8th Ave. between January and April of 2015.
Garcia was arrested Sept. 24, 2015, and charged with 19 separate counts, including five counts of sexual conduct with a minor, two counts of molestation of a child, four counts of sexual exploitation of a minor, four counts of administration of a dangerous drug (methamphetamine) to another person, two counts of child abuse, incest and possession of drug paraphernalia.
According to Safford Police reports, Garcia would force his daughter to smoke meth and drink alcohol with him and Schroeder and then make her join in on sexual activities. He also allegedly violated the victim various other times without the inclusion of Schroeder.
Schroeder said she participated in the sex acts with the juvenile victim because she would do anything to make Garcia happy.
The case against Garcia — who was previously profiled by the Courier (“Taking back the streets,” April 15, 2015) and KGUN 9 News, of Tucson, for his efforts to clean up Safford by walking the streets and picking up discarded drug paraphernalia — is pending.
He is next scheduled for a settlement conference hearing Wednesday, May 25, followed by a pretrial conference hearing May 31.
